Privacy Policy

This Privacy Policy explains how Samavik L.L.C-FZ ("Samavik", "we", "us"), operating the Cutaway service ("Cutaway", the "Service"), collects, uses, and protects personal data. Samavik L.L.C-FZ is registered in the Meydan Free Zone, Dubai, United Arab Emirates. We process personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the "PDPL"). Where we offer the Service to, or process the personal data of, individuals in the European Union or European Economic Area, we also act consistently with the EU General Data Protection Regulation ("GDPR").

1. Who is responsible for your data

The data controller is Samavik L.L.C-FZ. You can contact us about privacy matters at edward@samavik.com.

2. What data we collect

We collect the following categories of personal data:

  • Account and contact data: name, email address, phone number, company or dropzone name, and login credentials.
  • Customer data: where a dropzone uses Cutaway to produce a video for a tandem skydiving customer, we process that customer's name, contact details where provided, delivery status, and the video or still media in which they appear.
  • Video and media content: raw GoPro footage, uploaded stills, generated stills, preview videos, vertical social edits, and final edited videos, including audio, imagery, and file metadata such as timestamps and telemetry used for editing assistance.
  • Payment data: billing and subscription information processed through our payment provider. We do not store full card numbers ourselves.
  • Usage and technical data: IP address, device and browser type, app logs, crash/support reports, analytics, and diagnostic information about how the Service is used.
  • Communications: messages you send us and related correspondence.

3. Why we process your data and our legal basis

We process personal data to:

  • provide, operate, and maintain the Service, including importing, processing, editing, rendering, storing, and delivering videos;
  • create and manage accounts and authenticate access;
  • process payments and manage billing where paid plans are enabled;
  • communicate with you about the Service, support, updates, and enquiries;
  • improve, secure, and troubleshoot the Service;
  • comply with legal obligations.

Where the PDPL applies, our processing is based on consent, contract necessity, legitimate operational interests, and legal obligations as applicable. Where the GDPR applies, our legal bases are: performance of a contract (Art. 6(1)(b)), consent (Art. 6(1)(a)), legitimate interests in operating and improving the Service (Art. 6(1)(f)), and compliance with legal obligations (Art. 6(1)(c)).

4. Video footage of tandem customers

Cutaway exists to turn raw skydiving footage into finished videos. That footage may show identifiable people. Dropzones that use Cutaway are responsible for obtaining any consent required from their customers for filming, editing, storage, and delivery of the video. We process this footage on behalf of, and under instruction from, the dropzone for the purpose of producing and delivering the requested media.

5. Who we share data with

We share personal data only with service providers that help us run the Service, each bound to protect it. These currently include:

  • Hosting and infrastructure: Vercel for the website, Railway for the application API and workers, managed PostgreSQL and Redis services, and Cloudflare R2 for video and photo object storage.
  • Analytics: Vercel Analytics for website performance and usage analytics.
  • Payment processing: third-party payment processors where paid billing is enabled.
  • Email and communications: email delivery and business communications providers used to send customer links, support replies, and product updates.

We do not sell personal data.

6. International data transfers

We are based in the UAE and our providers may process data in other countries, including the EU/EEA, the United Kingdom, the United States, and elsewhere. Where we transfer personal data across borders, we use lawful transfer mechanisms and appropriate safeguards consistent with the PDPL and, where applicable, the GDPR.

7. How long we keep data

We keep personal data only as long as necessary for the purposes described here, or as required by law. Account data is kept while your account is active. Video footage, edited videos, generated stills, and delivery assets are retained while needed to provide the Service, support re-delivery, troubleshoot issues, and meet agreed dropzone requirements, unless a shorter or longer period is agreed with the dropzone.

8. Your rights

Subject to applicable law, you have the right to:

  • access the personal data we hold about you;
  • correct inaccurate or incomplete data;
  • request deletion of your data;
  • object to or restrict certain processing;
  • withdraw consent at any time, without affecting prior lawful processing;
  • request a copy of your data in a portable format where GDPR applies;
  • lodge a complaint with a competent supervisory authority.

9. Security

We use reasonable technical and organisational measures to protect personal data against loss, misuse, and unauthorised access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Cookies

We use cookies and similar technologies as described in our Cookie Policy.

11. Children

The Service is not directed to children. Where footage of a minor tandem customer is processed, the dropzone is responsible for ensuring that any required parent or guardian consent has been obtained.

12. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version here and revise the "Last updated" date above.
